General Terms and Conditions of Sale

Thibault CARVES is the manager of the individual company " Perigord Dordogne Montgolfières " registered at the RCS of Bergerac under the Siret number : 797 733 458 00021.

The head office is located at:
Lieu-dit "Tournepique" - 24250 Castelnaud-la-Chapelle.

The company is registered with the Civil Aviation Authority for public passenger transport under the commercial operator number FR.DEC.353 issued by the DSAC/SO in accordance with the provisions of EU Regulation No. 2018/395.
The company is also subject to the conditions stipulated in the Warsaw Convention.

The company operates the website http://www.perigord-dordogne- montgolfieres.com and offers online sales of flight tickets. The company reserves the right to modify, at any time and at its own discretion, the present terms and conditions of sale.

The general conditions in force are those present on the site at the time the buyer places his/her order.
The placing of an order by the buyer implies irrevocable acceptance of these general conditions, which the buyer acknowledges having read prior to placing his/her order. By accepting the present general conditions of sale, the buyer guarantees that he/she is of legal age and has full legal capacity to place an order on the site.

1. Our service

Take off to discover the Périgord from the sky, spend a great moment of aerial charm while being surprised by the beauty of the castles, villages and valleys on board a hot-air balloon basket. The flights are always varied in height, according to the aerology and the inspiration of the pilot. The pilot remains available for each passenger throughout the flight.

1.1. The one-hour flight

The duration of the flight is approximately 1 hour. As the balloon travels with the wind, the pilot cannot plan to land after exactly 1 hour of flight. The time can therefore be slightly shorter or slightly longer.

Approximately 40 minutes of preparation and inflation of the balloon are required from the time of the appointment.
Approximately 30 minutes of storage of the equipment are required after the landing.
The total service will therefore last between 2.5 and 3 hours.

NB: Each year, the flying season runs from the beginning of March to the end of October, depending on the weather conditions at the pilot's discretion.

The service includes:
1. Travelling in one of our vehicles from the meeting point to the balloon's take-off site;
2. Preparation and inflation of the balloon;
3. The mandatory safety briefing;
4. The balloon flight;
5. Storing the balloon;
6. The traditional balloonists' toast;
7. The return to the meeting point in one of our vehicles; 8. Civil liability insurance for air transport.

The buyer has descriptive information about these services on each of the pages of the site presenting them. The packages are proposed and organised by the company Périgord Dordogne Montgolfières.

1.3 Weather

Trust us ......
Every day we consult the weather information given by several specialised websites, while keeping our nose out. Being a pilot means above all having experience of weather forecasting, observation of phenomena and knowledge of local aerology.
However, it is difficult for us to establish the feasibility of the flight with certainty more than 48 hours before the flight.
A definitive confirmation will be sent to you by sms or e-mail 24 hours before the flight.

1.4. Hot air balloons and the team

1 to 4 qualified pilots are available to meet all requests.

The company has 5 hot-air balloons of different sizes, accommodating from 2 to 14 passengers.

Our equipment is renewed and maintained regularly to ensure the safety of all, but also to ensure a good appearance for our passengers and perfect manoeuvrability characteristics.

A hostess will welcome you at the time of your appointment. She will check-in and collect your flight tickets (by credit card, cheque, cash or ANCV vacation vouchers). You will then receive your ticket. Gift tickets, although already paid for, must be presented to her.
The ground crew member(s) - 1 or 2 depending on the size of the balloon - assists the pilot and passengers throughout the flight.

1.5. Our flying fields

In accordance with the regulations in force, the company has approved and declared take-off platforms. They are subject to a prefectural decree:

The choice of the take-off point is made at the time of the passenger welcome, according to the latest weather observations, in order to have an optimal trajectory in the valley of the castles.
The pilot is the only one to decide on the latter.

1.6. Reception of passengers

Passengers are welcomed near our main base in Castelnaud-la-Chapelle, at the place called Tournepique. Vehicles can be parked in the large (free) public car park at the bottom of the village.
The company cannot be held responsible for any damage to passengers' vehicles during the flight.

1.7 Timetable

For safety and comfort reasons, the hot air balloons never fly during the day. The company offers morning and evening flights.
For the morning flight, the meeting point will be at sunrise.
For the evening flight, the meeting point will be about 2 hours before sunset. The schedule changes every week. The exact time of the meeting will be given to you in a text message or in a flight confirmation e-mail, which you will receive 24 hours before the flight.

1.8. Accompanying persons

For safety reasons, accompanying persons are not allowed to enter the balloon take-off area. If the conditions allow it, they can be placed outside the field to observe the take-off. The company cannot be held responsible for the safety of accompanying persons.

1.9. Dress code

In general, the temperature in flight is 2-4°C lower than on the ground. We therefore recommend that you plan your clothing accordingly.
Synthetic clothing, especially fleece, is not recommended.
Skirts or dresses are also not recommended.
Closed, comfortable shoes are essential. Heeled shoes are not allowed.
Only small personal belongings are allowed on board (cameras, handbags) and no bulky luggage or backpacks.
A hat or cap is strongly recommended.
Also bring a bottle of water.

The passenger must abide by the safety rules explained by the pilot before boarding. It is strictly forbidden to smoke around and in the balloon during the inflation, flight and storage operations.

1.10. Boarding conditions

No one is allowed to board one of the company's hot-air balloons without a valid and nominative flight ticket. This ticket must have been paid for in advance by the passenger, by a third party or by a partner service provider.

As a passenger air carrier, the company Périgord Dordogne Montgolfières is subject to the conditions stipulated in the Warsaw Convention.
The company's pilots are the sole masters on board and, as such, they have authority over all the persons on board. They have the right to refuse to embark or disembark any person among the passengers who could present a danger for the safety, the health or the good order of the balloon.

1.11. Restrictions

The company is not qualified to judge the physical condition and fitness of passengers to fly. It is the passenger's responsibility to seek advice from the appropriate source (e.g. their own doctor).
If you are suffering from a serious medical condition or have recently undergone surgery, you may be asked to provide a medical certificate certifying your fitness to fly.

The pods are not equipped with seats.

Our gondolas are not suitable for passengers weighing more than 120kg, for safety reasons we will not be able to offer flights to these people.

The following persons are not allowed to fly:

- pregnant women;
- children under the age of six (6) and less than 1.20m;
- anyone under the influence of alcohol or drugs.

Children under the age of twelve (12) must be accompanied by an adult, with a minimum of one adult for every five (5) children. It is the responsibility of the accompanying adults to inform us of the exact age of the children.
Persons with a disability must be accompanied.
Hot-air balloons are not equipped with doors and cannot accommodate wheelchairs.
Animals are not allowed in flight.

1.12. Insurance

The company is covered for passengers during their balloon flight, in accordance with the civil aviation authorities, by the insurance company AIG, policy N°0000551320, represented by the broker ATLANTAS, 9 bd guist'hau, BP 51013, 44101 NANTES.
Risks are covered for amounts comparable to those required by the Warsaw Convention in terms of air transport of passengers

Objects carried by passengers are not covered by the company's insurance. The company's insurance does not cover damage to clothing, intentional injury or suicide, unless the company is at fault.
Passengers should therefore be particularly careful with their personal belongings. However, passengers are free to take out additional insurance if they consider it necessary.

1.13. Subcontractors

The company reserves the right to use subcontractors to carry out balloon flights. All subcontractors are approved by the French Civil Aviation Authority and comply with the company's procedures, described in its operations manual.

2. Book a flight

2.1. Reservation methods

There are several ways to book a flight:

At the time of booking, essential information will be requested for each passenger:

- Name and surname
- Telephone number
- Age and weight
- Health information (if available)

This information is treated as confidential.

For individual passengers, no deposit is required at the time of booking. Payment (by credit card, cheque or ANCV holiday vouchers) is made on the day of the flight, when the passengers are met.

If you have a gift ticket, you must inform us of this at the time of booking (stating the date of issue and the type of ticket). This must be presented at check-in.

2.2 Booking confirmation/flight confirmation

At the latest 48 hours before the flight, the passenger must confirm his presence by SMS or e-mail by reminding us of his name, given at the time of booking.

If the weather conditions are favourable, the day before the flight before 2pm, we will send you an SMS or e-mail confirming the flight, giving you all the details:

- Exact meeting time,
- Details of how to find the meeting point,
- Clothing advice.

You will be asked for confirmation of receipt. It is essential for us to validate your boarding.
Passengers may change their flight date up to the third day before the date of travel, subject to availability on the new date.

2.3. Flight cancellation

Ballooning is totally dependent on the weather. The company, on the decision of its pilot, reserves the right to change the take-off site, but also to cancel a flight until the moment of take-off, due to bad weather conditions, unfavourable wind directions, or a technical incident that could jeopardize the safety of the passengers or the pilot. The company is not liable for any costs incurred by its customers in the event of a flight cancellation.

When a flight is cancelled due to the company's decision, for weather or flight safety reasons, the passenger will be able to rebook for another date.

2.4. Payment of the service

The price of the services offered for sale is given in euros, inclusive of VAT and air transport liability insurance.
Passengers will be given a receipt of payment valid as a nominative flight ticket (one ticket is issued per reservation) including the following information:

  • surnames/first names of passenger(s)
  • billing address
  • telephone number
  • flight ticket price incl. VAT
  • date/flight slot and take-off location

The company records an invoice for each booking, which is sent by email immediately after the flight on request.

The company reserves the right to modify its prices at any time. The price applicable to the purchaser will be the price in force at the time the order is validated. Payment must be made by the purchaser using one of the following methods: Credit card, cheque, ANCV cheque (up to €200 per booking), cash (€200 banknotes are not accepted).

For customers who do not have a gift ticket: full payment must be made on the day of the flight, at the time of ticket purchase.

For groups of at least 4 passengers for the "flight" service and all bookings for private services, a credit card imprint will be requested at the time of booking: A pre-authorization of 50% (fifty percent) of the total booking amount will constitute a deposit blocked for up to one month. Tickets will be paid directly on the day of the flight and the pre-authorization cancelled. In the event of cancellation by passengers less than 24 hours before the flight, or no-shows without prior notification, the deposit will be forfeited.

For groups of 8 passengers or more, the final number of participants will be determined at least 15 days before the flight date and will serve as the basis for final invoicing.

The client is informed that, in accordance with Article L132-2 of the French Monetary and Financial Code, the order or commitment to pay given by means of a payment card is irrevocable. The payment may only be stopped in the event of loss, theft or fraudulent use of the card or of the data linked to its use, or in the event of the beneficiary's receivership or liquidation.

3. Offer a gift ticket

3.1. Placing an order

The buyer agrees to receive information about his order and its execution by e-mail.

In order to be able to place an order, the buyer must follow the following steps:

- choose a service,
- enter your contact details and the surnames and first names of the beneficiary(ies)
,
- accept these general terms and conditions of sale,
- leave a comment if necessary
- enter your payment method,
- check and confirm your order.

The company cannot be held responsible for any delay in the delivery of the ticket(s) ordered due to an error in the information entered by the buyer.

3.2 Confirmation of the order

The buyer will receive an e-mail confirming his/her order, which will be considered as an acknowledgement of receipt. This order confirmation will be sent to the e-mail address provided by the buyer (subject to a valid e-mail address) when creating his/her account, and will be considered as final validation of the order. The buyer will not be able to go back and modify his/her order once it has been confirmed by the company by e-mail.

3.3. Delivery of tickets

The tickets will be delivered by default to the billing address provided by the buyer when placing the order. If the buyer chooses to enter the beneficiary's address, the tickets will be delivered to the beneficiary.

The place of delivery may be located in Metropolitan France, in the DOM, the TOM and abroad. Delivery is included in the price of the tickets.

3.4. Withdrawal

The purchaser shall not have the right of withdrawal, in accordance with the provisions of 5° and 9° of I of Article L.121-16-1 of the Consumer Code. The contract will then be considered final at the time of confirmation of the order by the sending of an e-mail from the company to the buyer. The ticket will then be neither refundable nor exchangeable.

3.5. Validity - extension

The ticket will be valid for twelve (12) months from the date of issue (as shown on the ticket), with the flight period running from the beginning of March to the end of October each year.

In the event of cancellation of the flight for weather reasons, the beneficiary must inform us as soon as possible of his next availability.
He/she must make a minimum of three (3) flight attempts in twelve (12) months to be eligible for a free one (1) year extension. If the purchaser has made less than three (3) flight attempts during these twelve (12) months, the company will be able to extend the ticket by one year, at a cost of 35 euros per ticket, upon written request to the company's head office.
The validity of the ticket will be extended by one year free of charge for any passenger who can prove that his or her flight has been cancelled at least three (3) times by the company, whether for bad weather conditions or for any other security reason.

Any ticket older than two (2) years is permanently expired, regardless of the reason why it has not been used.

In the event of cancellation by the passenger(s) less than 24 hours before the flight or no-show, the ticket will be considered used.

All requests, for extensions or otherwise, must be made in writing to the company's head office before the ticket's expiry date. After this date, the ticket will be considered used up.

3.6. Payment

The price of the services offered for sale is indicated in euros, including VAT and air transport liability insurance.
The price in euros excluding VAT and the amount of taxes will be indicated on the "Order Confirmation" page.

The company reserves the right to modify its prices at any time. The price applicable to the purchaser will be the price in force at the time the order is validated. Payment must be made by the purchaser using the following methods of payment: Credit card, Bank transfer

The client is informed that, in accordance with Article L132-2 of the French Monetary and Financial Code, the order or commitment to pay given by means of a payment card is irrevocable. The payment may only be stopped in the event of loss, theft or fraudulent use of the card or of the data linked to its use, or in the event of the beneficiary's receivership or liquidation.

3.7. Acceptance of the General Terms and Conditions of Sale

For any order, the buyer must accept the general conditions of sale by ticking the box "I have read and accepted the general conditions of sale".

4. Legal provisions

4.1. Provisions of the Data Protection Act on personal data

In accordance with the French Data Protection Act of 6 January 1978, the buyer has the right to access, rectify and delete data concerning him/her. To do so, he/she must send a written request to the following address Périgord Dordogne Montgolfières - Tournepique - 24250 Castelnaud-la-Chapelle.

The company reserves the right to send the buyer commercial offers from the company or to inform him/her of special operations that it is organising, by e-mail sent to the address given by the buyer on the site. If the buyer no longer wishes to receive such offers, he/she may oppose them at any time by sending an e-mail to the address: contact@perigord-dordogne-montgolfieres.com, requesting the deletion of his/her address.

4.2. Intellectual property

The site and its contents, in particular the brands, logos, images, videos, drawings, models, texts, photographs, graphic charts and databases, are the exclusive, full and complete property of the company Périgord Dordogne Montgolfières. Any reproduction, representation, distribution, exploitation, marketing, use of elements present on the site, or of all or part of the site, is strictly forbidden.

4.3. Hypertext link

The insertion of a hypertext link to the site requires the prior written consent of the company.

4.4 Force majeure

The company's obligations shall be suspended in the event of force majeure, without the buyer being able to engage the company's liability.

In addition to those usually accepted by the Jurisprudence of the French Courts and Tribunals, the following are expressly considered as cases of force majeure or fortuitous events total or partial strikes, internal or external to the company, and in particular postal services, but also bad weather, epidemics, earthquakes, fires, storms, floods, water damage, blocking of telecommunications, blocking of the Internet, governmental or legal restrictions, legal or regulatory changes in the forms of marketing, and any other case beyond the express control of the parties preventing the normal execution of this contract.

4.5. Limitations of the Internet

The buyer acknowledges that he/she is aware of the characteristics and limits of the Internet, the possible presence of viruses, and the possible misappropriation of the buyer's data due to acts of piracy, for which the company cannot be held responsible. The same applies in the event of difficulties in accessing the site or malfunctions of the site, in particular due to acts of piracy. The company reserves the right to interrupt services for maintenance purposes, but can still be contacted by telephone.

4.6. Disputes

Any dispute, contestation, failure to settle or difficulty relating to our services will be subject to the jurisdiction of the Courts of Bergerac, with the sole exception of cases subject to the rules of public order jurisdiction.

4.7. Ombudsman

Suppliers of travel, tourism, accommodation, leisure and transport services have internal complaint handling structures to which customers should turn in the event of a dispute. However, in the event of persistent disputes, disputes arising from contracts concluded between the trader and the consumer may be subject to optional mediation free of charge to the consumer.

How to contact an ombudsman :

The consumer must refer the matter to the company's internal department responsible for settling disputes in the event of disagreements. In the absence of a satisfactory response or in the absence of a response within 60 (sixty) days, the customer may refer the matter to the Tourism and Travel Ombudsman, whose contact details and procedures for referral are available on its website: www.mtv.travel.

4.8. Applicable law

The present general conditions are subject to French law.
