Thibault CARVES is the manager of the individual business “Perigord Dordogne Montgolfières” registered with the Bergerac RCS under Siret number: 797 733 458 00021.
The head office is located:
Lieu-dit “Tournepique” – 24250 Castelnaud-la-Chapelle.
The company is declared to civil aviation for the public transport of passengers under the commercial operator number FR.DEC.353 issued by the DSAC / SO according to the provisions of EU regulation n ° 2018/395.
The company is also subject to the conditions stipulated in the Warsaw Convention.
The company operates the website http: //www.perigord-dordogne- montgolfieres.com and offers online sales of flight tickets. The company reserves the right to modify these general conditions of sale at any time and at its sole discretion.
The general conditions in force are those which are present on the site at the time when the buyer places his order.
The placing of an order by the buyer implies the irrevocable acceptance of these general conditions, which the buyer acknowledges having read before placing his order. By accepting these general conditions of sale, the buyer guarantees to be of legal age and have full legal capacity to place an order on the site.
1. Our service
We fly off to discover Périgord seen from the sky, spend a great moment of aerial charm while being surprised by the beauty of the castles, villages and valleys aboard a balloon basket. The flights are always varied in height, according to the aerology and the inspiration of the pilot. The pilot remains available for each passenger throughout the flight.
1.1. The one hour flight
The duration of the flight is approximately 1 hour. As the hot air balloon travels with the wind, the pilot cannot plan to land after exactly 1 hour of flight. The time can thus be slightly shorter or slightly longer.
Approximately 40 minutes of preparation and inflation of the balloon are required from the scheduled time of the meeting.
Approximately 30 minutes of equipment storage is required after landing.
The total service will therefore last between 2:30 and 3 hours.
NB: each year, the flight season extends from the beginning of March to the end of October, depending on the weather conditions at the discretion of the pilot.
The service includes:

We consult the weather information given by several specialized websites every day, while keeping our noses out. To be a pilot is above all to have experience in weather forecasting, observation of phenomena, and knowledge of local aerology.
However, it is difficult for us to establish the feasibility of the flight with certainty more than 48 hours before the flight.
A final confirmation will be communicated to you by sms or e-mail 24 hours before the flight.
1.4. The balloons and the team
2 to 3 qualified pilots are available to respond to all requests.
The company has 5 hot air balloons of different sizes that can accommodate from 2 to 10 passengers.
Our equipment is renewed and regularly maintained to guarantee the safety of all, but also to ensure a good appearance for our passengers and perfect handling characteristics.
A hostess will welcome you at the meeting time. It will check in and collect (by bank card, check or ANCV holiday vouchers) your flight tickets. She will give you a ticket. Gift tickets, although already paid, must be presented to him.
The ground crew member (s) – 1 to 2 depending on the size of the balloon – assist the pilot and passengers for the duration of the service.
1.5. Our flight grounds
In accordance with current regulations, the company has approved and declared take-off platforms. They are the subject of a prefectural decree:

The choice of take-off location is made when welcoming passengers, based on the latest weather observations, in order to have an optimal trajectory in the valley of the castles.
The pilot is the sole decision maker of the latter.
1.6. Passenger reception
Passengers are greeted near our main flight base, in Castelnaud-la-Chapelle, at a place called Tournepique. Vehicles can be parked in the large public parking lot (free) at the bottom of the village.
The company cannot be held liable for damage sustained on passenger vehicles during the service.
For safety and comfort reasons, hot air balloons never fly during the day. The company thus offers morning and evening flights.
For the morning flight, the meeting will be at sunrise.
For the evening flight, the meeting will be approximately 2 hours before sunset. Schedules change weekly. The exact time of the appointment will be given to you in a text message or in a flight confirmation email, which you will receive 24 hours before the flight.
1.8. Accompanying persons
For security reasons, accompanying persons are not allowed to enter the hot air balloon flight area. If conditions allow, they will be able to position themselves outside the field to observe the flight. The company cannot be held responsible for the safety of accompanying persons.

In general, the temperature in flight is 2 to 4 ° C lower than that on the ground. We therefore recommend that you plan the clothing accordingly.
Synthetic clothing and especially fleece is not recommended.
Skirts or dresses are also not recommended.
Closed and comfortable shoes are essential. Heeled shoes are prohibited.
Only small personal effects are accepted on board (cameras, handbags), excluding all luggage, bulky backpacks.
A hat or cap are highly recommended.
Also bring a bottle of water.
The passenger must comply with the safety rules explained by the pilot before boarding. As such, it is strictly forbidden to smoke around and in the hot air balloon during inflation, flight and balloon storage operations.
1.10. Boarding conditions
No one is allowed to board any of the company’s hot air balloons without a valid, nominative flight ticket. This ticket must have been paid in advance by the passenger, a third party or a partner service provider.
As an air passenger carrier, the Périgord Dordogne Montgolfières company is subject to the conditions stipulated in the Warsaw convention.
The company’s pilots are the only masters on board and, as such, they have authority over all persons on board. They have the right to refuse to embark or disembark any person among the passengers who could pose a danger to the safety, health or good order of the balloon.
The company is not qualified to judge the physical condition and fitness of passengers for flight. It is the passenger’s responsibility to seek advice from the right person (for example, from their treating physician).
You cannot fly if you have a serious medical problem or have just had surgery. , you may be asked for a medical certificate certifying your aptitude for the flight.
The nacelles are not equipped with seats.
The following people are not allowed to fly:
• pregnant women;
• children under six (6) years old and under 1.20m;
• anyone under the influence of alcohol or drugs.
Children under the age of twelve (12) must be accompanied by an adult, with a minimum of one adult for five (5) children. It is and is the responsibility of accompanying adults to tell us the exact age of the children.
People with disabilities must be accompanied.
Hot air balloons are not provided with doors, they do not can accommodate wheelchair users.
Pets are not allowed in flight.
The company is covered for passengers during their balloon flight, in accordance with the civil aviation authorities, by the insurance company AIG, policy N ° 0000551320, represented by the broker ATLANTAS, 9 bd guist’hau, BP 51013, 44101 NANTES.
The risks are covered for amounts comparable to those required by the Warsaw Convention in terms of air transport of passengers.
Items taken by passengers are not covered by company insurance. This does not cover damage to clothing, nor the case of intentional injury or suicide, except in the event of proven fault by the company.
The passenger must therefore be particularly vigilant with regard to his personal effects . Passengers are however free to take out additional insurance if they consider it necessary.
The company reserves the right to call on subcontractors to perform balloon flights. All subcontracting partners are approved by the French Civil Aviation Authority and comply with the company’s procedures, described in its operations manual.
2. Book a flight
2.1. Booking methods
Several methods allow you to book a flight:

When booking, essential information will be requested for each passenger:

This information is treated confidentially.
For individual passengers, no deposit is required at the time of booking. Payment (by bank card, check or ANCV holiday vouchers) is made on the day of the flight, when passengers are met.
If you hold a gift ticket, you must inform us at the time of booking (specifying the date of issue and the type of ticket). The latter must be presented at the time of registration.
2.2. Booking confirmation / flight confirmation
At the latest 48 hours before the flight, the passenger must confirm their presence by SMS or e-mail by reminding us of their name, given when booking.
If the weather conditions are favorable, the day before the flight before 2 p.m., we will send you a flight confirmation SMS or e-mail giving you all the details:
– Exact meeting time,
– Details to find the welcome point,
– Dress advice.
You will be asked to confirm receipt. It is essential for us to validate your boarding.
The passenger retains the possibility of changing the date of his flight until the third day preceding this date, subject to availability for the new date chosen.
2.3. Flight cancellation
The balloon flight is totally dependent on the weather. The company, on the decision of its pilot, reserves the right to change the take-off site, but also to cancel a flight until take-off, due to bad weather conditions, unfavorable wind directions, or a technical incident that could jeopardize the safety of passengers or that of their pilot. The company is not liable for any costs incurred by its customers in the event of the cancellation of a flight.
When the cancellation of a flight comes from the decision of the company, for weather or security reasons related to the flight, the passenger can make a new reservation for another date.
3. Offer a gift ticket
3.1. Placing an order
The buyer agrees to receive information relating to his order and its execution by email.
In order to place an order, the buyer must follow the following steps:
– choose a service,
– fill in his contact details as well as the first and last names of the beneficiary (ies),
– accept these general conditions of sale,
– possibly leave a comment
– fill in the payment method,
– check and confirm your order.
If an error in the entry of information by the buyer should lead to a delay in the delivery of the ticket (s) ordered (s), the company can in no way be held responsible. p>
3.2. Order confirmation
The buyer will receive an email confirming his order, serving as an acknowledgment of receipt. This order confirmation will be sent to the email address provided by the buyer (subject to a valid email address) when creating their account, and will constitute final confirmation of the order. The buyer can no longer return to his order to modify it, once it has been confirmed by the company by email.
3.3. Delivery of tickets
Tickets will be delivered by default to the billing address provided by the buyer when placing the order. If the buyer chooses to enter the beneficiary’s address, the tickets will be delivered to the latter.
The place of delivery may be located in mainland France, the French overseas departments and territories, and abroad. Delivery is included in the ticket price.
The buyer will not have a right of withdrawal, in accordance with the provisions of 5 ° and 9 ° of I of article L.121-16-1 of the consumer code. The contract will therefore be considered final when the order is confirmed by sending an email from the company to the buyer. The ticket will be neither refundable nor exchangeable.
3.5. Validity – extension
The ticket will be valid for twelve (12) months from the date of issue (written on the ticket), knowing that the flight period extends from the beginning of March to the end of October each year.
In the event of cancellation of his flight for meteorological reasons, the beneficiary must inform us as soon as possible of his next availability.
He must make a minimum of three (3) flight attempts in twelve (12) months to be able to benefit from a free one (1) year extension. If the buyer has made less than three (3) flight attempts during these twelve (12) months, the company may extend his ticket for one year, at a cost of 35 euros per ticket, upon written request to company headquarters.
The validity of the ticket will be extended by one year at no cost to any passenger proving that their flight has been canceled at least three (3) times by the company, whether for reasons bad weather conditions or for all security reasons.
Any ticket over two (2) years old has expired, regardless of the reason why it has not been used.
Any request, extension or other, must imperatively be made before the expiration date of the ticket, by written request at the headquarters of the company. After this date, the ticket will be lost.
The price of the services offered for sale is indicated in euros, including VAT, VAT and air transport liability insurance included.

The company reserves the right to change its prices at any time. The price applicable to the buyer will be the price in effect at the time of validation of the order. Payment must be made by the buyer using the following payment methods: Bank Card, Bank Transfer, Check, or ANCV Holiday Checks.
For individual customers: full payment must be made on the day of the flight, when purchasing the ticket.
For groups of at least ten (10) people, the payment must be staggered over time with the payment of a deposit of thirty (30) percent upon booking. The balance must have been paid in full on the day of the flight. The final number of participants will be decided at least 15 days before the flight date and will serve as the basis for final invoicing.
The customer is informed that in accordance with article L132-2 of the Monetary and Financial Code, the order or the commitment to pay, given by means of a payment card is irrevocable. Payment may only be objected to in the event of loss, theft or fraudulent use of the card or of the data linked to its use, reorganization or compulsory liquidation of the beneficiary.
3.7. Acceptance of the General Conditions of Sale
For all orders, the buyer must accept the general conditions of sale by checking the box “I have read and accepted the general conditions of sale”.
4. Legal provisions
4.1. Provision of the Data Protection Act on personal data

The buyer acknowledges having knowledge of the characteristics and limits of the Internet, the possible presence of viruses, and possible misappropriation of the buyer’s data due to hacking acts, which the company cannot be held responsible. The same is true in the event of difficulties in accessing the site or malfunctions of the site, in particular linked to acts of piracy. Any litigation, any dispute, any defect of regulation or any difficulty relating to our services, will be subjected to the competence of the Courts of Bergerac, with the only exception of the cases subjected to the rules of the competence of public order. p>
Travel, tourism, accommodation, leisure and transport service providers have internal complaint handling structures that customers should contact in the event of a dispute.
